E. The amended Public Law 114-113 fee (if applicable): $4,000

H1B Visa Extension Process for Spouses:

Spouses of H-1B holders are eligible to extend their H-4 upon the expiration of the 6-year limit. This extension is usually granted as long as the H4 holder has not committed any crimes or violated the visa or immigration rules.

However, just because the first H-1B holder has received an extension, it does not automatically grant all connected H4 holders extensions as well.

It is important to remember that H-4 recipients must file the I-539 concurrently with the original H-1B extension application along with proof of the relationship with the primary H1B holder.

H1B Visa Extension Processing Time:

Extension should be filed as early as six months before the current stay expires. Filing your extension early is critical.

Because of delays in obtaining a prevailing wage determination from the US Department of Labor, we might be unable to file the H-1B petition with USCIS before the current period of authorized stay expires, requiring the employee to depart the US and await processing abroad.

Petitions Exempt From H-1B Cap

There are a few ways to be considered H-1B cap exempt. U.S. Employer matches one of the following categories:

1. Higher Education Institution

3. Non-profit research or government organization

4. Beneficiaries who will work in Guam or the Northern Mariana Islands. (Applicable until December 31, 2014).

If H-1B cap exemption has been previously granted for the beneficiary, he/she will not be subject to the cap.

The following will continued to be processed with cap exemption by the USCIS:

1. Extension of stay in the United States for current H-1B holder.

2. H-1B holder has a change in terms of employment

3. H-1B holder changing employers

4. H-1B holder working jointly with a second H-1B position

You will not need to pay fees in order to enter the lottery, but you will have to pay all applicable H-1B fees if you are selected for the cap.

Will premium processing be suspended again?

Unfortunately, there is no way of determining whether or not premium processing will be suspended. It was suspended in the past so that petitions without premium processing could be adjudicated and now it seems as though the USCIS is caught up. Is there an LCA fee?
